Terms of Service

1. Parties and Agreement
These Terms of Service ("Terms") form a legally binding agreement between you ("User") and Helloo.Club, a unit of RemotIQ Pty Ltd ("we", "us", "our"), the operator of Helloo.Club (the "Platform"). By registering for or using the Platform, you confirm that you have read, understood, and agree to these Terms and all policies incorporated by reference.
2. Nature of the Service
Helloo.Club is a multipurpose social platform. It enables users to engage in AI-assisted conversation, discover people with shared interests, participate in communities, and connect with trained human agents. It is not a licensed counselling, psychotherapy, medical, crisis intervention, or emergency service. If you are in crisis or require immediate mental health support, please contact Lifeline Australia on 13 11 14 or your local emergency services.
3. Eligibility
You must be at least 16 years of age to use the Platform. By registering, you represent that you meet this requirement. Users aged 16 to 17 require parental or guardian consent. We reserve the right to verify age at any time and to suspend accounts where eligibility cannot be confirmed. See Document 6 for the full Age Policy.
4. Account Obligations
You agree to provide accurate, current, and complete information when registering. You are responsible for all activity under your account and must not share your credentials with others. You must notify us immediately at legal@helloo.club if you suspect unauthorised access to your account.
5. Acceptable Use
You must not use the Platform to:
- harass, threaten, stalk, or abuse any person, including human agents or other users
- send or solicit sexually explicit content involving minors
- engage in fraud, impersonation, or deceptive conduct
- extract personal information from human agents or other users without consent
- use the Platform for commercial solicitation, spam, or affiliate marketing
- scrape, harvest, or systematically collect data from the Platform
- attempt to bypass safety filters, age verification, or security measures
- use the Platform in breach of any applicable Australian or international law
6. Human Handover
You may request a human agent at any time using the in-app handover feature. Human availability is subject to operating hours displayed in the app. Outside these hours, your request will be queued and responded to as soon as practicable. See Document 8 for the full Human Handover Policy.
7. AI-Generated Content
Conversations with the AI are generated by a large language model and do not constitute advice of any kind — legal, medical, financial, psychological, or otherwise. AI responses may occasionally be inaccurate or incomplete. You should not rely on AI-generated content for important decisions.
8. Intellectual Property
All platform content, branding, software, and functionality are the property of RemotIQ Pty Ltd (ABN 91 682 628 128) or its licensors and are protected under Australian intellectual property law. You may not reproduce, distribute, or create derivative works from our content without written permission.
9. Termination
We may suspend or terminate your account at any time for breach of these Terms or any associated policy. You may close your account at any time via account settings. On termination, your access to the Platform ceases immediately.
10. Disclaimer
The Platform is provided on an "as is" and "as available" basis. To the extent permitted by law, RemotIQ Pty Ltd (ABN 91 682 628 128) excludes all implied warranties. Nothing in these Terms limits rights you may have under the Australian Consumer Law (ACL).
11. Limitation of Liability
To the maximum extent permitted by Australian law, RemotIQ Pty Ltd (ABN 91 682 628 128)'s total liability to you shall not exceed the total fees paid by you in the three months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or punitive loss.
12. Governing Law
These Terms are governed by the laws of Western Australia, Australia. Disputes shall be submitted to the courts of Western Australia, Australia, or if applicable, to the ACCC or a relevant state consumer tribunal.
13. Changes to These Terms
We will provide at least 14 days' notice of material changes via email or in-app notification. Continued use after the effective date constitutes acceptance.
